A foreign nation who desires to enter the United States must first obtain a visa either a non immigrant visa for temporary stay or an immigrant visa for permanent residence. The type of visa you should possess is specified by immigration law, and associates with the purpose of your travel.

Types of Visas to work, study or travel to the USA
A USA visa is a permit to enter America. It grades the visit as tourism, study, short term business or full time work, and normally permits multiple entries to the USA within a specified period of time.

Visa Categories:
1) Immigrant Visa: is for someone who intends to live and work permanently in the USA (Green Card - Lawful Permanent Residents).
2) Non-immigrant Visa: is for someone to come temporarily to the USA for a specific purpose. It is usually on an H1B Work Visa, F1 Study Visa, J1 Training Visa, E1 Investors Visa, TN Work Visa, L1 Intra-Company Transfer Visa, K and V Fiancée Visas.

H1B Visa / Permit Program Overview - the primary USA work visa / work permit.
The US Government offers the H1B visa to enable highly skilled International Workers and International Students, from all over the World, or already in the USA, the opportunity to legally live and work in America.

The Process to obtain an H1B visa:
~ To obtain an H1B visa, an applicant must, first, find a job with an H1B visa employer company in the USA; commonly known as your 'H1B sponsor'.
~ The 1st step is to find a Sponsorship Job with an H1B sponsor company
~ Your H1B sponsor then applies for / files your H1B visa application. Individuals can NOT sponsor or apply for their own H1B visa - ONLY your new employer (sponsor) can.
~ An H1B visa is typically valid for up to six (6) years and entitles your spouse (husband/wife) and children to accompany you and 'live' in America.
~ One of the main advantages of the H1B visa (US work permit) is that it is a 'dual intent' visa which means that you can apply for a Green Card (Legal Permanent Residency).
~ Individuals can never sponsor/apply for their own H1B, it has to be done by the employer.

H2B Visa / Permit Program Overview – It is for short term 'seasonal' jobs / work.
The US Government offers the H2B visa as a great way for foreign nationals who want to live in USA for a short spell working in seasonal and fun jobs.

The Process to obtain an H2B visa:
~ The 1st step is to find a Sponsorship Job with an H2B sponsor company.
~ An applicant must 1st have a job offer from a US employer to perform a temporary job.
~ The applicant must meet the minimum qualifications for the job that the employer offers.
~ The duration of the H2B is limited to the employer's need for the temporary workers.
~ The normal maximum period is one year. H2B's can be extended up to three years in some situations.
~Individuals can never sponsor/apply for their own H2B visa - only the new employer can.
